Terms of Service

These terms govern your use of valipage.io (the "Service"), operated by Chrissy [Last name], trading as Petipois ("Valipage," "we," "us"), a sole trader based in France.

By creating an account or using the Service, you agree to these terms. If you don't agree, don't use the Service.

1. What Valipage does

Valipage lets creators ("you," "Creator") build and publish waitlist landing pages and collect email signups from visitors ("Signups"). We provide the page generator, hosting for published pages, and tools to manage and export collected signups.

2. Accounts

• You need an account, authenticated via Clerk, to create and manage projects.
• You're responsible for keeping your login credentials secure and for all activity under your account.
• You must provide accurate information and be legally able to enter into these terms.

3. Your content

• You're solely responsible for the content of the waitlist pages you create — the copy, claims, pricing, and imagery.
• You must have the right to use anything you upload or write (text, images, branding).
• You're responsible for complying with applicable law in how you collect and use Signup data, including telling Signups what you intend to do with their email address.
• We can remove or disable any project that violates these terms, applicable law, or that we reasonably believe is fraudulent, abusive, or harmful — for example, pages used for phishing, scams, or collecting data under false pretenses.

4. Signup data and the 30-day export cycle

This is central to how the Service works, so it's worth stating clearly here as well as in our Privacy Policy:

• Email addresses submitted to your waitlist pages are stored for 30 days from the date of signup.
• After 30 days, we automatically email you a CSV export of the signups collected for that project during that period, and then permanently delete that data from our systems.
• It is your responsibility to download and store the exported CSV somewhere safe. Once deleted, we cannot recover Signup data, regardless of whether the export email was successfully delivered, opened, or downloaded.
• We are not liable for data loss resulting from this scheduled deletion, undelivered export emails (e.g. due to spam filtering or an incorrect account email), or your failure to retain the exported file.

If you need a different retention arrangement, contact us — we may offer this on certain plans in the future, but it isn't currently part of the Service.

5. Payment

• Paid plans are billed via Stripe. By subscribing or purchasing, you authorize us to charge the payment method on file.
• Prices are as displayed at checkout and may change with notice for future billing periods.
• Refunds are handled case-by-case; contact petipoisdev@gmail.com.

6. Acceptable use

You agree not to use the Service to:

• Collect personal data unlawfully or without a legitimate basis
• Send spam, or use collected emails for purposes you didn't disclose to Signups
• Impersonate any person or entity, or misrepresent your affiliation
• Upload malicious code, or attempt to disrupt or gain unauthorized access to the Service
• Violate any applicable law or third party's rights

7. Availability and changes

• We aim to keep the Service running reliably but don't guarantee uninterrupted availability.
• We may modify, suspend, or discontinue features of the Service at any time, with reasonable notice where the change is material.

8. Termination

• You may stop using the Service or delete your account at any time.
• We may suspend or terminate accounts that violate these terms.
• The 30-day signup retention and auto-delete cycle continues to apply to any data already collected, regardless of account status, unless deletion already occurred.

9. Disclaimers and liability

• The Service is provided "as is," without warranties of any kind, express or implied.
• To the maximum extent permitted by French law, we are not liable for indirect, incidental, or consequential damages, including loss of data (subject to Section 4 above), loss of revenue, or loss of business arising from your use of the Service.
• Nothing in these terms excludes liability that cannot be excluded under French or EU law.

10. Governing law

These terms are governed by French law. Any dispute will be subject to the exclusive jurisdiction of the courts of [your local jurisdiction / commercial court], without prejudice to any mandatory consumer-protection rules that may apply to you.

11. Changes to these terms

We may update these terms from time to time. We'll update the date above, and for material changes we'll make reasonable efforts to notify you by email.
